Jury rendered defense verdict after only 30 minutes of deliberations on liability case
On November 7, 2024, Jody Benard, Partner and New York Team Leader for Dodd DelCollo’s Insurance Defense Practice Group, obtained a unanimous defense verdict on liability in the Suffolk County Supreme Court in the case of Scott Doumas v JCWC, LLC, Index No. 619958/2018, Judge George Nolan presiding. The jury rendered the verdict after only 30 minutes of deliberations.
This proceeding arose out of a slip-and-fall incident that occurred in the evening of Sunday, July 2, 2017, in Lake Ronkonkoma, New York. Ms. Benard represented the owner of a small strip mall where the plaintiff claims to have been injured after slipping on a recurring condition in the parking lot. Finding no liability on the part of the owner, the jury did not make it past the first question, determining that the parking lot was in a reasonably safe condition on the date of the accident.
